Shark Divers Club — Terms & Conditions
1. Introduction
These Terms & Conditions (“Terms”) govern your booking, attendance and participation in tours, courses, events, dive trips and other services (“Services”) provided by Shark Divers Club East Coast Scuba Diving UAE (“Shark Divers”, “we”, “us”, “our”). By booking or participating you accept these Terms.
2. Definitions
- Participant / You: any person booking or participating in Services.
- Booking: any reservation, payment or registration for Services.
- Instructor / Crew: Shark Divers’ authorized staff.
3. Booking and Payment
- A service is confirmed when we send a booking confirmation and receive any required deposit or full payment.
- Payment can be accepted online, by card, bank transfer or in-person as listed at time of booking.
- Prices shown include applicable fees and taxes unless stated otherwise.
- You must supply correct contact, medical and certification details at booking.
4. Cancellations and Refunds
- Cancellations by You:
- More than 7 days before: full refund (less non-refundable deposit, if any).
- 48 hours–7 days before: 50% refund.
- Less than 48 hours / no-show: no refund.
- Special events, private charters or peak season bookings may have different cancellation terms; these will be stated at booking.
- Cancellations by Us:
- We may cancel or reschedule due to weather, safety, insufficient numbers, mechanical issues or other operational reasons. If we cancel, you will be offered an alternative date or full refund.
- Refunds are processed to the original payor within a reasonable time.
5. Health, Fitness & Medical Conditions
- Diving and many water activities involve inherent risks. You must be medically fit to participate.
- You must complete truthfully any medical questionnaire and disclose conditions (e.g., heart, respiratory, ear/nose/throat issues, pregnancy, recent surgery, medications).
- If you answer “yes” to any disqualifying questions you must provide a medical clearance from a physician prior to diving.
- We reserve the right to refuse participation on medical or safety grounds. No refund will be issued if refusal follows undisclosed medical conditions.
6. Age & Certification Requirements
- Minimum ages for specific activities will be stated at booking.
- For scuba diving, valid certification may be required; if uncertified, an introductory program with different terms may be offered.
- You must bring proof of certification and ID where required.
7. Safety & Instructions
- Follow all instructions of our staff and the dive briefing. Safety briefings are mandatory.
- Use of safety and emergency equipment is compulsory when instructed.
- Failure to follow instructions may result in termination of participation without refund.
8. Equipment & Loss/Damage
- Equipment provided is maintained to industry standards. Report any issues before use.
- You are responsible for loss or damage to equipment due to negligent or intentional acts and may be charged repair/replacement costs.
- Personal equipment should be in good condition. We are not responsible for loss/damage to personal property unless caused by our negligence.
9. Photography & Media
- We may take photos or video during Services for marketing and training. By participating you grant Shark Divers a perpetual, royalty-free right to use media featuring you. If you object, notify staff prior to activity.
- Third-party photographers’ images may be made available for purchase; we are not responsible for their use beyond terms disclosed at sale.
10. Insurance
- You must have appropriate travel, accident, and dive insurance covering diving activities (including emergency evacuation and hyperbaric treatment). Proof may be requested.
- If you do not hold suitable insurance you participate at your own risk.
11. Assumption of Risk, Release & Limitation of Liability
- Diving and water activities involve risks that may result in injury, illness, death, property loss or damage.
- To the maximum extent permitted by law, you assume all risks and release Shark Divers, its owners, employees, agents, and contractors from liability for injury, illness, death or property loss/damage arising out of participation, except where caused by our gross negligence or willful misconduct.
- Our liability for any claim is limited to the total fees paid for the specific Service giving rise to the claim or as required by applicable law.
12. Indemnity
- You indemnify and hold Shark Divers harmless from any claims, losses or costs (including legal fees) arising from your breach of these Terms, negligence, willful misconduct or failure to follow instructions.
13. Force Majeure
- We are not liable for failure or delay caused by events beyond our reasonable control (weather, natural disasters, strikes, government acts, COVID-19 restrictions, etc.). We will attempt to offer alternatives or refunds where appropriate.
14. Behaviour & Removal
- Unruly, intoxicated or unsafe behavior is prohibited. We may remove you from Services without refund if your behavior compromises safety or enjoyment of others.
15. Complaints & Refund Requests
- Raise complaints with staff at the time of incident. Formal complaints should be emailed within 7 days with supporting details. We will respond promptly and fairly.
16. Privacy
- Personal data is processed in accordance with our Privacy Policy (available on our website). By booking you consent to processing required for service provision.
17. Third-Party Providers
- Where services are provided by third parties (charter operators, accommodation, training agencies), their terms may apply in addition to these Terms. We act as agent or organiser as stated at booking.
18. Amendments
- We may amend these Terms from time to time. Updated Terms are effective when posted; material changes will be notified to booked participants where reasonably practicable.
19. Severability
- If any provision is invalid or unenforceable it will be severed and the remaining provisions remain in force.
20. Governing Law & Jurisdiction
- These Terms are governed by the laws of the United Arab Emirates. Any dispute will be subject to the exclusive jurisdiction of UAE courts, unless otherwise agreed in writing.
